The petitioner are apprehending their arrest in connection with Koderma P.S. Case No. 94 of 2025, registered for the offence under Sections 274, 275 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 47(a) of Excise Act, pending in the court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioners submits that petitioner No. 1 is a lady and she is the owner of the motorcycle and petitioner No. 2 is the husband of petitioner No. 1. He submits that it has been alleged that on the said motorcycle 34 bottles of foreign liquor were recovered. He next submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-12 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that illegally the foreign liquor was being carried on the motorcycle. [ 2026:JHHC:6749] -2- 5. Considering that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-12 of the petition and further considering the quantity of liquor, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
