The said bail was granted on 13.11.2024. More than 17 months have passed since such bail was granted to the accused persons. Report submitted by the State reflects that, case has been committed to the Court of Sessions being the learned Additional Sessions Judge, 5th Court, Alipore and the next date is fixed on 12.05.2026 for appearance and consideration of charges. Having considered the stage of the case, at this belated stage, I am not inclined to interfere with the order of bail. However, the petitioner would be at liberty to bring any subsequent instances which reflect that the accused persons are misusing the liberty which creates an impediment in the 2 smooth progress of the trial of the case. If such an application is brought to the notice of the learned Trial Court, learned Trial Court will decide the same in accordance with law without being influenced by any observations of this Court. Accordingly, CRM (DB) 4154 of 2024 is disposed of. Status report submitted by the State be kept with the record. Report enclosing the acknowledgment of the opposite party submitted by the State be also kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
