GP FOR HOME 2 The Court made the following ORDER: The Writ Petition has been filed for the following relief: “…to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in calling the petitioner to the police station regarding a civil dispute as arbitrary, illegal and contrary to law, and consequently direct the respondent police not to call the petitioner to the police station by interfering in civil disputes…” 2. Heard learned counsel for the Petitioners and the learned Assistant Government Pleader. 3. Mr. B.Pardhasaradhi, learned counsel appearing for Ms. Y. Bhanu Sri Akhila, learned counsel for the Petitioners, submits that the respondent No.1 has been calling the petition to police station with regard to civil dispute and subjecting him to harassment. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that one Bantupalli Jayalakshmi has lodged a complaint in PGRS against the petitioner, and that respondent No. 1 has conducted a preliminary enquiry under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), and came to know that the dispute between the petitioner and the third party is civil in nature. Except for the purpose of conducting the preliminary enquiry, the petitioner was never called to the police station nor subjected to any sort of harassment. 5. Considering the facts and circumstances of the case and recording the submissions of the learned Assistant Government Pleader, the Writ 3 Petition is disposed of, directing the respondent No.1 not to call the petitioner to the police station henceforth and subject him to harassment of any sort by interfering the civil disputes in between the petitioner and third party without following due process of law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y.
