The case of the prosecution is that the Local District Revenue Officer preferred a complaint before the respondent police alleging that a fake No Objection Certificate was obtained by A1 (Shajagan) for his land in Survey No.230(1) and 23(20)(a), situated at Sathuperry Village, Vellore Taluk and District, to an extent of 51 hectares, by falsely representing the land as non- agricultural. Insofar as the allegation against the present petitioner is concerned, it is stated that he introduced A1 to a person who is alleged to have created the fake document. Hence, the case. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl. Side) strongly opposed the petition and submitted that the petitioner had a role in creating a bogus No Objection Certificate and received a sum of Rs.85 lakhs. It is further submitted that A1 received a sum of Rs.80 lakhs, out of which Rs.30 lakhs was transferred to the petitioner, and that the said amount has not yet been recovered. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available. 6. Considering the seriousness of the allegations, the stage of investigation, and the fact that the amount involved has not yet been recovered, this Court is of the view that if anticipatory bail is granted, it would jeopardize the prosecution case. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
