1. Heard the learned counsel for the parties.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.09.2025 in connection with Simdega P.S. Case No. 128 of 2008, corresponding to G.R. Case No. 359 of 2008, for the alleged offence registered under Section 302 of Indian Penal Code said to have been pending in the court of learned Chief Judicial Magistrate, Simdega.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case on account of land dispute.

The learned counsel for the opposite party-State has opposed the prayer and has submitted that the petitioner is named in the First Information Report (F.I.R) and the allegation is that the petitioner had assaulted the wife of the informant due to which she expired and the petitioner has evaded arrest for 16 years and the victim died due to assault.
5. After hearing the learned counsel for the parties and considering the facts and circumstances and particularly the fact that there is direct allegation against the petitioner and the petitioner was declared absconder and evaded arrest for 16 years, this Court is not inclined to enlarge the petitioner on bail.

6. The instant bail application is rejected.
