Learned counsel appearing on behalf of the petitioner submits that he has been falsely implicated in this case. The allegation is of lynching of the victim by a violent mob. Reliance has been placed by the State on the postmortem report and the statements of witnesses implicating the present petitioner as one of the assailants. Learned counsel for the State also refers to an order passed by a Coordinate Bench of this Court rejecting the bail application of one of the accused after ten months of custody. Orders of proclamation and attachment have also been issued against the petitioner. Considering the above, the other incriminating materials available in the case diary and the fact that orders of proclamation and attachment have also been issued against the petitioner, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner. 2 The application for anticipatory bail of the petitioner is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
