The present writ petition is filed questioning the inaction of the Respondents in sanctioning and disbursing the Family Pension to the Petitioner from the date of demise of her husband on 14.06.2013 as illegal and arbitrary. The husband of the petitioner by name Late Vaddadi Sanyasi Rao was served in the Army in the Madras Engineer Group (MEG) (Army No.1378998). While so, the first marriage of the husband of the petitioner was dissolved vide a Decree of Divorce in O.P.No.200 of 1999 passed by Senior Civil Judge, Anakapalli, dated 02.12.2003. Thereafter, the petitioner married Sanyasi Rao on 24.03.2007 in accordance with Hindu rites and customs and the Certificate of Marriage was also issued by the Marriage Registrar/ Joint Sub- 2 SL. NO. DATE ORDER OFFICE NOTE Registrar, Sabbavaram, vide Certificate of Registration bearing Reg.No.32 of 2012 dated 19.11.2012. In course of time, the husband of the petitioner was expired on 14.06.2013 at Pedamusidivada Village. Though the petitioner submitted relevant documents to the respondents for sanction of Family Pension and other terminal benefits in accordance with the rules, the same is not being considered, the present writ petition is filed. Heard the learned counsels. Considering the submissions made, there shall be an interim direction as under: i) The respondents shall examine the claim of the petitioner for sanction of ‘Family Pension’ and other terminal benefits within a period of two months from today. ______ VN, J MMK/eha 3
