CMP(MD) No.10407 of 2024 in AS(MD) No.25 of 2022 P.VELMURUGAN,J. and B.PUGALENDHI,J. This Civil Miscellaneous Petition has been filed by the appellants to permit them to produce the FMB sketch (along with measurement calculation) and Photo (stone inscription on the building) as additional evidence in AS(MD)No.25 of 2022. 2. The petitioners herein/appellants have contended jthat the proposed documents were not marked as evidence before the trial Court by mistake and such non production of those documents before the trial Court is neither wilful nor wanton. However, the said documents are essential to arrive at a just conclusion. Hence, this petition may be allowed. 3. In this case, Ex.A3-copy of Survey and Resettlement Register of Kadhaparai Village and Ex.A5-copy of UDR Register marked before the 1 https://www.mhc.tn.gov.in/judis trial Court categorically mention the suit property as a "Temple Poramboke" and in Ex.A3, the respondent temple's name is explicitly reflected in the remarks column. Based on the said documents, the trial Court decreed the suit holding that the claim of the petitioners/appellants that 'poramboke' implies only the Government's ownership is factually incorrect and legally unsustainable. Though the petitioners proposed to introduce FMB sketch (along with measurement calculation) and Photo (stone inscription on the building) as additional evidence in this appeal, that will not help the case of the petitioners, since Exs.A3 and A5 categorically mentions the suit property as temple poramboke and that the name of the respondent's temple also finds place in the said documents. 4. Hence, this Civil Miscellaneous Petition stands dismissed. (P.V.,J.) (B.P.J.,) .01.2026 bala 2 https://www.mhc.tn.gov.in/judis
