JUSTICE INDERJEET SINGH Order 01/07/2026 This writ petition has been filed by the petitioner with the following prayers:- “It, is therefore, prayed that :- i) This writ petition may kindly be allowed the impugned notification dated 8.6.2001 of the Finance Department i.e., the Rajasthan Civil Services (Revised Pay Scale) (IIIrd Amendment) Rules, 2001 may kindly be declared to be ultra vires. ii)the By further appropriate writ order or direction the recovery made from the gratuity of the petitioner in view of the impugned amendment dated 8.6.2001, may kindly be declared to be illegal and the respondents may be directed to restore the position of the petitioner as if the amendment dated 8.6.2001 had never been made and as if the petitioner's salary had never been reduced and [2026:RJ-JP:24104] (2 of 2) [CW-3829/2003] the recovery made from the gratuity of the petitioner may kindly be ordered to be made good and paid to the petitioner with interest @ 24% per annum from the date of recovery. iii)By further appropriate writ, order or direction, the fixation made in the pay scale of Rs.5500-9000 w.e.f. 1.7.1998 may kindly be declared to be illegal and the respondents may be directed to restore the same position of the pay Scale of Rs. 6500-10500 w.e.f. 01-09- 1996 in the Rajasthan Civil Services (Revised Pay Scale) Rules, 1998 originally framed. iv) By further appropriate writ, order or direction the respondents may be directed to the petitioner interest @ 24% per annum on account of delayed payments on retiral benefits as the petitioner retired on 30.11.2002 while retiral benefits have been given on 19.4.2003. v)Any other appropriate writ, order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances case may also in favour of the petitioner. vi) The Cost of this writ petition may also kindly be awarded in favour of the petitioners.” This writ petition was filed by the petitioner in the year 2003 after his retirement. I have perused the record and the issue involved in this petition. In my considered view, after lapse of twenty years, this writ petition has become infructuous.
