The petitioner is apprehending his arrest in connection with Jamua P.S. Case No.10/2025, registered for the offence under Sections 74, 78, 62, 351(2) of the BNS, 2023 and Section 12 of POCSO Act, pending in the Court of the learned Special Judge, POCSO Act, Giridih. 3. Learned counsel appearing for the petitioner submits that the petitioner and the informant are neighbour and prior to lodging of the present case, an FIR being Jamua P.S. Case No.03/2025 has been lodged on behalf of the petitioner’s family alleging therein that due to drainage dispute, family members of the informant have assaulted the victim’s brother. He further submits that the present case has been lodged six days after the first case filed on behalf of the petitioner’s family. He then submits that the present case is a counter blast case of the said case. He next submits that the petitioner is a student, aged about 19 years and he has appeared in the Secondary Examination, conducted by Jharkhand Academic Council, Ranchi. To buttress this argument, he refers to Annexure-2 of this application, which is provisional certificate. ( 2026:JHHC:3278 ) -2- A.B.A. No. 7364 of 2025 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there against the petitioner of threatening the daughter of the informant. 5. It transpires that Jamua P.S. Case No.03/2025 has been lodged on 15.01.2025 due to the altercation took place with regard to dispute relating to drainage and the present case has been lodged on 21.01.2025. It appears that the petitioner is a student in light of Annexure-2. In that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms, conditions or sureties as the learned Court may deem fit and proper. 6.
