Lenka, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 23.02.2026 01. 1. Heard learned counsels for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Naikandihi P.S. Case No.289 of 2025 corresponding to G.R. Case No.1287 of 2025 pending in the file of learned J.M.F.C., Basudevpur, District-Bhadrak on the grounds stated therein. 3. Perused the P.R. as at Annexure-1. The incident dated 20th November, 2025 was reported on 23rd November, 2025, consequent upon which, Naikandihi P.S. Case No.289 was registered. It is made to reveal from Annexure-1 that the petitioner committed the excess after entering into the house of the informant forcibly. The details of the mischief committed by the petitioner stand narrated in Annexure-1. It is informed to the Court that the petitioner is having no other past antecedent. Considering the above submission and objection of the State, this Court is not inclined to grant pre-arrest bail to the petitioner, however, is of the view that he should surrender before the learned court below for being released with stringent conditions. 4. Accordingly, it is ordered. 5. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that upon surrender before the court of learned J.M.F.C., Basudevpur, District- Bhadrak within a fortnight from today, the petitioner shall be released on bail in connection with Naikandihi P.S. Case No.289 of 2025 corresponding to G.R. Case No.1287 of 2025 subject to him furnishing a bail bond of Rs.30,000/- (Rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case and such release shall be subject to absence of criminal antecedent against him. 6.
