Today during course of hearing a communication dated 6th April, 2026 of Officer-in-Charge, Karaya Police Station, Kolkata is filed and same is taken on record. Copy of the said communication dated 6th April, 2026 is made over to the learned advocate representing the petitioner. 2. It is disclosed in the communication dated 6th April, 2026 that based on the complaint lodged by the petitioner a criminal prosecution being Karaya P.S. Case No.48 of 2026 dated 2nd March, 2026 was initiated under Sections 126(2)/ 115(2)/ 351(2)/ 54 of Bharatiya Nyaya Sanhita, 2023 against the respondent nos.4 to 6. 3. In connection with the aforesaid criminal prosecution notice under Section 94 of BNSS was issued upon the petitioner for production of relevant documents. On the other hand, notice under Section 35(3) of BNSS was issued upon respondent nos.4 to 6 and they complied with the same. 2 4. In view of aforesaid situation, at this stage, no further order need be passed on this writ petition. 5. However, concerned police authorities are directed to take the criminal prosecution being Karaya P.S. Case No.48 of 2026 dated 2nd March, 2026 to its logical conclusion at an early date. 6. Concerned police authorities are also directed to maintain peace and tranquility at the locale. 7. Writ petition stands disposed of. 8. Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
