CORAM: JUSTICE V. NARASINGH
Order No.
ORDER 09.01.2026
01.
1. Since both the matters arise out of same F.I.R, they are heard together and disposed of by this common order on the consent of the parties.
2. Heard learned counsel for the Petitioners and learned counsel for the State as well as the Informant. p. 2
3. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.74 of 2023 pending on the file of learned J.M.F.C., Tigiria, Cuttack, arising out of Tigiria P.S. Case No.76 of 2023 for commission of offences punishable under Sections 147/ 148/ 341/ 323/ 325/ 326/ 307/ 302/ 354/ 294/ 506/ 149 IPC along with Section 25 & 27 of Arms Act
4.
Learned counsel for the Petitioner, taking into account the nature of allegations and placing reliance on the order dated 20.02.2024 passed by this Court in BLAPL No.10549 of 2023, seeks release of the Petitioners on pre-arrest bail.
5.
Learned counsel for the State opposes the prayer for pre-arrest bail and brings to the notice of this Court that in the aforementioned order on which reliance has been placed that the Petitioner Nos.2 and 3, who were granted bail, were not named accused, whereas the present Petitioner in ABLAPL No.127 of 2026 is cited as accused No.23 and the Petitioner in ABLAPL No.128 of 2026 is the first accused.
6. Considering the nature of allegations which are inter alia, under Sections 302 and 303 of IPC, this Court is not inclined to entertain the application for pre-arrest bail. However, in the p. 3 event the Petitioners surrender before the learned Court in seisin and move an application for their release on bail, the same shall be considered on its own merit.
Ground of parity, if so urged, shall be taken into account.
7. Accordingly, the ABLAPL stands disposed of.
