ORAL ORDER
The petitioners are before this Court calling in question proceedings in C.C.No.22955/2017 registered for the offences under Sections 498A and 506 of the IPC.
2. Heard Sri. Rajashekara R.V., learned counsel appearing for the petitioners, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri. Muthu D.L.,
learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit. The joint affidavit so filed reads as follows:
"JOINT AFFIDAVIT
We, Sri. Harish S/o Narasimhan, Aged about 44 years, R/at No.92, 4th cross, ITC Colony, Cox Town, Jeevana Halli, Frazer Town, Bengaluru-560 005. AND Smt. Ambika W/o Harish N, Aged about 39 years, R/at No.92, 4th cross, ITC Colony, Cox Town, Jeevana Halli, Frazer Town, Bengaluru-560 005, Do hereby solemnly affirm and state on oath as follows:-

1. We are the accused persons No.1 and 2. 2. The Respondent No.2 is the Complainant in C C No.22955/2017 for offence punishable under section 498(A), 504, 506 of IPC and section 3 and 4 of Dowry prohibition Act, Against the accused No.1 and 2/Petitioners. 3. We state that petitioner No.1 and 2 and 2nd Respondent respectively in the above case and we are well conversant with the facts of the case. Hence, we are swearing to this affidavit. 4. The 2nd petitioner is unable to appear before this Hon'ble Court and her presence may be dispense in the above case due to ill health and also the Complainant/respondent No.2 is agreed to close the case. 5. We are submits that, in memorandum of settlement under section 89 R/w rules 24 and 25 of the Karnataka Civil Procedure (MEDIATION) Rules 2005, we are resolved the disputes and agreed to the settlement condition number No.9 we are agreed to co-operate in closing/Quashing the proceedings in C C No.22955/2017 Pending before the XI Additional Chief Judicial Magistrate Mayohal at Bengaluru filed against me and another for the offence punishable under section 498(A), 504,506 of IPC and section 3 and 4 of Dowry prohibition Act. We are produced the copy of the mediation report for Kind perusal of this Hon'ble Court. 6.
We submit that in view of the intervention of respectable persons of the Bar it has been resolved to withdraw the above case and on the advice of the said persons and at the instance of elders, well wishers and friends we have amicably settled the matter amongst ourselves and do not intend to precipitate the matter further, as such we have amicably decided to close the matter to the following conditions:-
a. We are agree if any cases/complaints pending before any courts/authorities filed against each other shall be withdrawn in terms of this settlement. - 5 -

b. We are also agree withdraw all the allegation made against respondent and other either in this petitioners in connected cases or orally and there is no undue influence, force, or coercion in entering into this agreement from anyone or anything. WHEREFORE, We most humbly pray that this Hon'ble Court may be pleased allow the above petition FIR( in C C. No.22955/2017 Halsuru Gate Women Police, pending on the file of learned XI Additional Chief Judicial Magistrate, Mayohal At Bengaluru, under section 498(A), 504,506 of IPC and section 3 and 4 of Dowry prohibition Act, Against the accused No.1 and 2/Petitioners. What is stated above is true to the best of our knowledge, belief and information."
4. In the light of the joint affidavit being filed and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 5. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.22955/2017 pending before the XI Additional Chief Metropolitan

Magistrate, Bengaluru, stand quashed qua these petitioners.
