Sushil Kumar Pramanik Vs. The State of West Bengal & Ors.
Mr. Robiul Islam Mr. K. M. Hossain Mr. Sk. Jayed Hossain Mr. Sumitra Das …. for the petitioner
Mr. Sougata Mitra Mrs. Kakali Naskar …. for the State
1. Let affidavits-of-service, as filed in Court, be kept on record.
2. In spite of repeated service, there is no representation on behalf of the school authorities.
3. If reticence had a face, it would most certainly be that of the respondent nos. 4 and 5. The order of this Hon’ble Court of 2011 and 2014, directing the school authorities to accept the petitioner as headmaster, since the petitioner had been duly recommended on January 6, 2010, was ignored with impunity.
4. The petitioner had been running from pillar to post from 2010 till about 2015, with two separate writ petitions before this Hon’ble Court. The petitioner was permitted to join as the headmaster only in 2015 under the threat of a contempt proceeding.
2
5. The petitioner now prays for notional benefit of his retiral dues for the period of 2010 to 2015.
6. However, as pointed out by Mr. Mitra, learned Advocate appearing for the State, petitioner has not made requisite representation before the concerned District Inspector of Schools (S.E.).
7. Let such representation be made by the petitioner on April 20, 2026.
8. Respondent no. 3, concerned District Inspector of Schools (S.E.), is directed to immediately dispose of the representation by May, 10, 2026, in accordance with the provisions of law keeping in mind that the petitioner will retire on May 31,
2026.
9. With the aforestated direction, the writ petition is disposed of.
10. There shall, however, be no order as to costs.
11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
