The petitioner is seeking regular bail connection with R.C. Case No. 01(A)/2024(D), for the offence registered under Sections 120B r/w Sections 420, 465, 468 and 477A of Indian Penal Code and under sections 13 (2) r/w 13(1)(b) of Prevention of Corruption (Amendment) Act, 2018, pending in the Court of learned Special Judge, C.B.I.-cum-Additional District Judge-V, Dhanbad. 3. Mr. R.S. Mazumdar, learned senior counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case only due to ulterior motive of the informant. He next submits that the petitioner the then Sub-Post Master in K.K. Polytechnic, Sub-Post Office, Govindpur, Dhanbad and the allegations are made of defalcation of Rs.9,38,24,019/- (Nine Crore Thirty-Eight Lakh Twenty-Four Thousand Nineteen). He next submits that the petitioner has made his confessional statement under Section 164 of Cr.P.C. and he has accepted his role in defalcation. He also submits that the petitioner has cooperated in the investigation 2026:JHHC:249 2 and the charge-sheet has been submitted. He next submits that the petitioner is in custody since 17.07.2025. On these grounds, he submits that regular bail may kindly be granted. 4. Mr. Deepak Bharti, learned counsel appearing for the CBI opposed the prayer and submits that the act of the petitioner is against the society. He then submits that it has come in the charge- sheet that the petitioner was the Sub-Post Master in K.K. Polytechnic, Sub-Post Office, Govindpur, Dhanbad during the period of 05.04.2022 to 08.02.2024 and was authorized / given the role of both maker and checker in the Finacle Software and the petitioner is expert in computer. He then submits that the petitioner by way of manipulating the said software has siphoned Rs.9,38,24,019/- (Nine Crore Thirty-Eight Lakh Twenty-Four Thousand Nineteen). He next submits that the petitioner is also involved in cricket betting. He then submits that there is serious allegation against the petitioner of defalcating a sum of Rs.9,38,24,019/- (Nine Crore Thirty-Eight Lakh Twenty-Four Thousand Nineteen) of the K.K. Polytechnic, Sub-Post Office, Govindpur, Dhanbad by way of manipulating the Finacle Software of the Post Office. 5. It has been pointed out that the petitioner is an expert in operation of the computer and the petitioner has also defalcated of other account of investors and that fact is also admitted by the petitioner himself. The petitioner was a responsible government officer and he has dared to do so and the charge-sheet has been filed recently i.e. on 05.08.2025 and the supplementary charge-sheet on 2026:JHHC:249 3 30th October 2025. 6. In view of the above and in the attending facts and circumstances of this case, I am not inclined to release the petitioner on regular bail. 7. Accordingly, prayer for bail stands rejected.
