Barman for the petitioner Ranjit Barman who has filed this application under Section 442 read with Section 438 and 528 of the BNSS, 2023 with prayer for setting aside the judgment and order dated 02.05.2026 passed in Criminal Appeal No. 13/2021 by the learned Sessions Judge, Nalbari upholding the judgment and order dated 17.08.2021 passed by the learned JMFC, Nalbari in PRC case No.32/ 2018. The petitioner was convicted vide judgment and order dated 17.08.2021 under sections 324/447 and sentenced to undergo simple imprisonment for four months and to pay a Page No.# 3/3 fine of Rs. 5000/- and under Section 447 IPC to undergo simple imprisonment one month and to pay a fine of Rs. 400/- with default stipulation. 3. Learned Additional Public Prosecutor Mr. R.J.Baruah for the State respondent is present. 4. The petitioner has also prayed for suspension of sentence and to allow him to remain on previous bail. 5. I have considered the submissions at the bar with circumspection. 6. The operation of the impugned order of sentence dated 17.08.2021 in connection with PRC case No.32/ 2018 as well as the order dated 02.05.2026 passed in Criminal Appeal No.13/2021 passed by the learned Sessions Judge, Nalbari is stayed until further order. The petitioner is also allowed to remain on previous bail. 7. Call for the original records of PRC case No.32/ 2018 and Criminal Appeal No.13/2021 . 8. Meanwhile, issue notice to the respondents, returnable within 04(four) weeks. 9. The interlocutory application being I.A. (Crl.) No.685/2026 is disposed of. 10. List after 04(four) weeks.
