A notice was issued to the petitioner under Section 4(1) of U.P. Public Premises (Eviction of Unauthorised Occupants) Act, 1972. Petitioner submitted reply; however, his only defence was that he is in occupation over the land in question for quite some time. 3. Since petitioner was not able to establish that he had any right, title and interest over the land in question and the land in question was State land, therefore learned Prescribed Authority passed order of eviction against the petitioner on 22.04.2016. The appeal filed by petitioner was dismissed by District Judge, Rudraprayag vide judgment UKHC010030812016 2026:UHC:6930 dated 03.09.2016. Petitioner has challenged both these others. 4. This Court is not inclined to interfere with concurrent finding of facts returned by both the Courts below. 5. Even otherwise also, there is no material brought on record, which may indicate that petitioner had any semblance of right, title and interest over the land in question. 6.
