Petitioner owns agricultural land in Village Rehmatpur Ahatmal, Pargana & Tehsil Roorkee, District Haridwar, which was acquired by National Highway Authority of India for construction of National Highway. 6. According to petitioner, even though the land was acquired in the year 2021-22, however, compensation, due for such acquired land, has not been paid. The reliefs sought in the writ petition are as follows:- (a) A Writ, Order, or Direction in the nature of Mandamus commanding Respondent Nos. 2 and 3 to immediately disburse and credit the awarded compensation amount of Rs. 1,35,000,00/-(Rupees One Crore Thirty five Lakhs Only) to the Petitioner Khasra number 101 situated in village Rahmatpur Ahatmal Pargana and Tehsil Roorkee District Haridwar on Bank account of the Petitioner pursuant to the Award dated 06.03.2023. (b) A Writ, Order, or Direction directing the Respondents to pay statutory interest under the applicable law from the date of taking physical possession till the actual date of payment to petitioner Khasra number 101/28[254], 101/29[143], 101/31[143], 101/32[143], 101/33[143], of the petitioner situated in village Rahmatpur Ahatmal, Pargana and Tehsil Roorkee District Haridwar. (c) A writ, order or direction in the nature of mandamus to pay compensation to the petitioner of expenditure incurred in the litigation due to negligence and illegal and arbitrary conduct of the respondents authorities. Learned counsel for NHAI, on instructions, submits that the amount determined as compensation by Competent Authority Land Acquisition has been deposited by his client vide letter dated 19.04.2023. Thus, nothing remains to be paid by NHAI. 8. Learned State Counsel submits that the Competent Authority Land Acquisition has determined the compensation vide order dated 05.08.2026, and the amount determined as compensation would be paid to all the land owners, including the petitioner. He, however, submits that there is a title dispute going on between petitioner and one Mr. Rampal Singh S/o Buddhu Singh, therefore, till the time, title dispute is decided, it would be difficult to release the compensation to the petitioner for the entire land. 9. Learned counsel for the petitioner, however, submits that petitioner’s land, comprised in five Khatas, was acquired, however, the dispute pertains to only one Khata and other four Khatas are without any dispute, therefore, compensation can be paid for the remaining Khatas regarding which there is no dispute. 11. The writ petition is, accordingly, disposed of with a direction to the Competent Authority Land Acquisition to examine whether there are certain Khatas belonging to the petitioner regarding which there is no title dispute, and if it is found that those Khatas are without any title dispute, as contended by petitioner’s counsel, then compensation for the same may be released in favour of petitioner. However, regarding the Khata for which title dispute is going on before Settlement Officer Consolidation, the payment of compensation would be made as per the decision taken by Settlement Officer concerned.
