The petitioner, a Headmaster in a School, which has been upgraded in the year 2016, is aggrieved that the additional increment of 3% receivable by a Headmaster, has not been paid to him. 3. Ms. Chakraborty, learned Advocate appearing for the State, submits that the financial benefit was withheld in view of a subsequent Government Order (GO) dated 22.03.2017 bearing no. 292-SL. 4. However, it was fairly admitted by Ms. Chakraborty that in WPA/23867/2017, this Hon’ble Court has set aside the afore-stated GO of 22.03.2017 bearing no. 292-SL. 5. Thus, the petitioner is entitled, as the Headmaster, to avail the benefits of 3% increment along with additional grade pay, as payable in terms of Memo No. 866-SE/S/3S-94/14 (Pt-I) dated 14.07.2016. 6. The concerned District Inspector of Schools (DI) will consider the application made by the petitioner on 03.11.2025 and shall dispose of the same by 31.05.2026. 7. The petitioner will also furnish an undertaking stating that he will refund the money, if the Government, at a future date, as a matter of policy, replaces the afore-stated memorandum of 14.07.2016. 8.
