The instant petition is moved under Section 528 of BNS, 2023 by Anil Kumar, son of Prem Lal Nautiyal, for expediting the proceedings of Criminal Case No. 3678 of 2019 (State Vs. Javed Qureshi), arising out of FIR dated 11.05.2019 bearing FIR No. 128 of 2019 wherein respondent no. 2 has been implicated for the offences punishable under Section 406, 420 IPC, registered at Police Station – Nehru Colony, District Dehradun, pending in the court of Addl. Chief Judicial Magistrate, Dehradun. 4. Applicant lodged an FIR dated 11.05.2016 bearing FIR No. 128 of 2019 against the respondent no. 2 for the offences punishable under Section 406, 420 IPC and after investigation, charge sheet has been filed against the respondent no. 2 for the offences punishable under Section 406, 420 IPC. Thereafter, respondent no. 2 moved a bail application bearing Bail Application No. 1346 of 2019 before this Court and on 17.10.2019, the bail application was listed and respondent no. 2 made a statement before this Court that he is ready to pay 50% of the amount but till date he has not paid any single penny. Respondent no. 2 is adopting delaying tactics to delay the trial and the trial is being regularly adjourned on one pretext or another and there is no substantial progress in the UKHC010143982026 2026:UHC:7403 trial. 5. In such view of the matter, the instant petition is disposed of with the direction to the trial court to expedite the proceedings of Criminal Case No. 3678 of 2019 (State Vs. Javed Qureshi) pending in the court of learned Addl. Chief Judicial Magistrate, Dehradun as expeditiously as possible, preferably within a period of one year from the date of production of certified copy of this order.
