5. Petitioner is tenant in a building situate in Village Dharchula Dehat, Post Office Fultri, District Pithoragarh, part of which has been acquired by National Highway Authority of India for widening of road under Bharatmala Pariyojna.
6. Petitioner apprehends that acquired portion of the building, in which branch of petitioner-bank is functioning, would be demolished by respondent no. 3, which is nominated as Executing Agency by National Highway Authority of India.
7. By means of this writ petition, petitioner has sought a direction to

2026:UHC:7318 respondent nos., 2, 3 & 4 not to demolish any part of the building, which has been leased out to the petitioner-bank, for a period of eight months so that petitioner may find some alternative accommodation.
8. Any interference in the work of strengthening of Pithoragarh- Dharchula-Garbyang road would be unwarranted, as the said road is of strategic importance and due to adverse weather conditions; construction work is possible only during a small window period.
9. The writ petition, however, is disposed of with liberty to petitioner to make representation to the competent authority in National Highway Authority of India. If he makes such representation within three days from today, decision thereupon shall be taken, as per law, within one week thereafter. Till decision is taken on the representation, status quo as regards the building in question in which branch of the petitioner is housed, shall be maintained. However, if petitioner fails to make representation within three days, he shall not be entitled to any protection of this order and the authorities shall be at liberty to proceed in the matter, as per law.
