None. HON'BLE MR. JUSTICE INDERJEET SINGH Order 30/06/2026 This writ petition has been filed by the petitioner with the following prayer:-
“It is, therefore, humbly prayed that :- (i) By an appropriate writ, order or direction,
revised
pay scale of Senior Teacher prescribed as 5000- 8000 under Item No.5(b) of Schedule (IV) may kindly be struck down right from the date of enforcement of the rule. i.e. 17.2.1998 and the respondents may kindly be directed to grant the revised pay scale of 6 500-10500 (No.12) as per Schedule-1 Section A of the Rajasthan. Civil Services (Revised Pay Scales) Rules, 1998. (ii) By an appropriate writ, order or direction, the Rajasthan Civil Services (Revised Pay Scales) (Sixth Amendment) Rules, 1998 whereby the entry scale. under the revised pay scales made effective from
[2026:RJ-JP:23873] (2 of 3) [CW-6492/2003] 1.9.1996 as 5000-8000 may kindly be declared ultra vires of Article 14, 16 & 21 of the Constitution as well as contrary to Rule 6 with a further direction to make entry scale for Senior Teacher of 6500-10500 (12) as per Schedule-1 Section A of the Rajasthan Civil Services (Revised Pay Scales) Rules,
1998. (iii) By an appropriate writ, order or direction, General Note No. 8(i) & 8(ii) of the Rajasthan Civil Services (Revised Pay Scales) Rules, 1998 vide amendment dated 8.6.2001 may kindly be extended to petitioner who was working in same unrevised pay scale or in the alternative the same may kindly be struck down being ultra vires of Article 14, 21 & 300-A of the Constitution of India. (iv) By an appropriate writ, order or direction, respondent be further directed not to make any discrimination between the Senior Teachers working in the existing pay scale of 2000-3200 (14) and 2000-3500 (15) and whose pays have been revised to 6500- 10500 (12) as per Schedule-1 Section-A of the Rajasthan Civil Services and further continue/grant them pay scale of 6500-
10500.
(v) By an appropriate writ, order or direction, order of refixation dated 1.1.2003 & 12.6.2003 may kindly be quashed and set aside and original fixation order dated 30.5.1998 may kindly be restored. (vi) By an appropriate writ, order or direction,
respondents may kindly be restrained from recovery in pursuance of the order-dated 12.6.2003. (vii) Any other suitable order or direction, which
this Hon'ble Court deems expedient in the facts and circumstances of the case, may kindly be passed
in favour of the petitioner. (viii) Cost of the writ petition may kindly be awarded in favour of the petitioner.” As per affidavit submitted by the petitioner alongwith the writ petition, he was 55 years old at the time of filing of the writ petition in the year 2003. [2026:RJ-JP:23873] (3 of 3) [CW-6492/2003] In my considered view, as of now, the petitioner has retired from service after attaining the age of superannuation, therefore, by efflux of time, the present writ petition has become infructuous.
