This Writ Petition is filed for a Mandamus directing the 2nd respondent to terminate the Indian Oil Petrol Bunk Dealership of the petitioner situated in Survey No.5/1D, Theerthamalai Village, Harur Taluk, Dharmapuri District and consequently directing the 2nd respondent to vacate the premises and handover the possession of the land to the petitioner. 3. The case of the petitioner is that he is operating an Indian Oil Petrol Bunk dealer from 12.12.2012 and the petroleum outlet is situated in Survey No.5/1D, Theerthamalai Village, Harur Taluk, Dharmapuri District, which is a joint family property owned by the petitioner along with his brothers. However, due to abnormal circumstances, he was unable to operate the petrol retail outlet since 2022 and the outlet has remained non-functional and has not generated any income whatsoever. Therefore, the petitioner has submitted a detailed representation on 08.01.2025 to the District Collector, requesting cancellation of NOC issued in favour of the respondent and termination of his dealership in order to reclaim his land to meet out his family expenses. In pursuant thereto, DRO conducting an enquiry, however the 2nd respondent issued a letter alleging that the petitioner had not participated in the enquiry and called for explanation from the petitioner. The petitioner has also submitted a detailed explanation to the respondents and despite receipt of the said explanation, the respondents have not taken any decision and hence, the petitioner is before this Court. https://www.mhc.tn.gov.in/judis WP No.7192 of 2026 __________ Page3 of 5 4. Heard both sides and perused the materials on record. 5. Considering the limited prayer sought for, this Court, without going into the merits of the case projected by the petitioner, directs the 2nd respondent to consider the explanation submitted by the petitioner and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after providing opportunity to the petitioner and the second respondent. 6. Accordingly, this Writ Petition is disposed of.
