1. Mr. Mukesh Kumar Kaparuwan,
learned counsel for the petitioner.
2. Mr. Ghanshyam Joshi, learned Additional C.S.C. for the State of Uttarakhand.
3. Petitioner was running a De- addiction Centre at Rishikesh. Chief Medical Officer, Dehradun directed the petitioner to close the said De-addiction Centre vide order dated 01.06.2026.
4. Learned State Counsel submits that the impugned order was issued on 01.08.2026, but due to typographical error date is wrongly mentioned as
01.06.2026. He further submits that during inspection, it was found that De- addiction Centre run by petitioner does not meet the norms regarding infrastructure laid down in Mental Healthcare Act, 2017. He further submits that petitioner’s De-addiction Centre was granted temporary registration on 08.01.2026 for three months only, and registration was never renewed thereafter. He submits that without registration, no one can run a De- addiction Centre, in view of provisions of

5. Having regard to the submissions made by learned State Counsel, this Court do not find any scope for interference with the impugned order, whereby petitioner’s De-addiction Centre was directed to be closed.

Learned counsel for the petitioner submits that the De-addiction Centre now meets all prescribed norms.

If what is contended on behalf of petitioner is correct, then petitioner shall be at liberty to apply for registration of the De-addiction Centre and also to request the Competent Authority for inspecting the same. Subject to petitioner’s making such application, the Competent Authority shall take decision on the application for registration after holding inspection, within six weeks from the date of presentation of application along with certified copy of this order.
8. With the aforesaid direction, the writ petition stands disposed of.
