For Petitioner(s): Mr.V.S.Senthilkumar For Respondent(s): Mr.P.Dhileepan, Government Advocate (Crl.Side) ORDER The petitioner, who was arrested and remanded to judicial custody on 07.03.2026 for the alleged offence under Section 310(2) of BNS, 2023 subsequently, altered to Sections 238, 310(2), 310(4) & 61(2) of BNS, 2023 in Crime No.65 of 2026 on the file of the respondent police, seeks bail. 2. Hence, the complaint. 3. The learned counsel for the petitioner submits that this petitioner was implicated upon the confession statement. It is further submitted that the petitioner’s marriage was proposed to be held today i.e.,25.03.2026 and the reception to be held on 26.03.2026. Hence, he prayed to grant bail to the petitioner. 4. The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the petitioner is the master mind and the accused extorted 4 kgs 160 grams gold jewels and a sum of Rs.5,50,000/- from the de facto complainant and called A1, and that only based on the scientific evidence, the petitioner was implicated in this case. He further submits that the police authorities have already proposed to register a case under the Goondas act against A1 to A7 Hence, he vehemently opposed to grant bail to the petitioner. 5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record. 6. Considering the nature of allegation against this petitioner and the stage of the investigation and upon the fact that still a sum of Rs.5,50,000/- is https://www.mhc.tn.gov.in/judis CRL OP No. 7864 of 2026 __________ Page3 of 4 to be recovered, this Court is of the view that, if any indulgence is shown to the petitioner based on his marriage ground, the same would directly jeopardise the prosecution case.
