Mr. S. Routray, Advocate -versus-
State of Odisha & Others …. Opp. Parties
Mr. S. Behera, AGA
CORAM:
THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA
Order No.
ORDER 19.02.2026
01.
amit
1. This matter is taken up through Hybrid mode.
2. Heard learned counsel for the Petitioner as well as leaned Additional Government Advocate for the State. Perused the Writ Petition as well as the prayed made therein.
3. By filing the present Writ Petition the Petitioner has sought for the following reliefs:
“Issue a writ in the nature of Mandamus or any other appropriate writ/writs,
order/orders or direction/directions directing the Opposite Parties, more particularly Opposite Party No.l to allow the petitioner to continue as Junior Lecturer on adhoc basis in the discipline of Botany by issuing her posting order as has been done in respect of other ad hoc teaching staffs vide notification dtd. 11.07.2023 and 31.08.2023 under Annexure-10 series and the Notification dtd. 30.12.2025 under Annexure-8 within a reasonable time to be stipulated by this Hon'ble Court.
And further the opp parties more particularly the opp party No-1 be directed to pay the salary component to the petitioner for December, 2025 till date.”
4.
Learned counsel for the Petitioner at the outset contended that pursuant to an advertisement, the Petitioner was appointed as Junior Lecturer (+2) in the Botany Department on ad hoc basis w.e.f.
01.09.2014. In the year 2014 the appointment order was issued in favour of the Petitioner for the post of Junior Lecturer (+2) Botany on consolidated basis. Thereafter, the Petitioner joined at SCS Junior College, Puri on 20.09.2016. Since that date, she has been discharging her duties uninterruptedly. While this was position, on 24.11.2025 another order was passed by way of appointing any PGT in various Departments in the Higher Education Department.
5.
Learned counsel for the Petitioner at this juncture contended that pursuant to the order of the Higher Education Department, the Petitioner joined in the Higher Education Department as is evident from order dated 29.11.2025 at Annexure-7. The sole grievance of the Petitioner is that although the Petitioner has joined in the Higher Education Department as is evident from the document at Annexure-7, however, she has not been posted in any of the Colleges. Learned counsel for the Petitioner alleges that the Petitioner has not been paid salary although she has joined in the Higher Education Department. Being aggrieved by such
inaction of the Opposite parties, the Petitioner has approached this Court by filing the present Writ Petition.
6.
Learned counsel for the State on the other hand contended that although he has no specific instruction in the matter, however, the Petitioner pursuant to the
order dated 29.11.2025 at Annexure-7 has already joined in the Higher Education Department. Thereafter, the Notification which was issued on 30.12.2025 by the Department of Higher Education, the name of the Petitioner has not included in it. Therefore, the Petitioner has approached this Court by filing the present Writ Petition. He further submits that he has no objection if the Opposite Party No.1 is
directed to consider the grievance of the Petitioner within a stipulated time.
7. Considering the submissions made by the learned counsel for the parties, the documents annexed to the Writ Petition and Annexure-7, this Court thinks it proper to dispose of the Writ Petition at the stage of admission by granting liberty to the Petitioner to approach the Opposite Party No.1 for redressal of his grievance. In the event, such application is moved, the Opposite Party No.1 would do well to consider the grievance of the Petitioner strictly in accordance with law by passing a reasoned and speaking order within a period of six weeks. It is further directed that the Opposite Party No.1 shall ensure that the salary of the
Petitioner be paid to him as is due and admissible to the Petitioner.
8. With the aforesaid observation and direction, the Writ Petition stands disposed of.
