2/07.01.2026 Heard learned counsel appearing on behalf of Petitioner and
learned counsel appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Sindri Police Station Case No. 72/2022, registered under Sections 420, 467, 468, and 471 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st class, Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the name of the petitioner has come in the confessional statement and the allegation against the petitioner is made that the petitioner has facilitated to sit in examination of another person. He also submits that the petitioner is imparting private tuition. He next submits that the person, who sat in the examination has been acquitted by the learned Court by the
Judgment dated 29.09.2023 passed in Juvenile Case No.2082 of
2022. He also submits that the person, in whose favour, he sat in the examination has also been granted anticipatory bail in ABA No.772 of 2023.

Learned counsel appearing for the State opposed the prayer and

submits that the name of the petitioner has come in the confessional statement.

Considering that only allegation against the petitioner is that he has facilitated a person to sit in the examination in place of another person, the name of the petitioner has come in the confessional statement, the person, who sat in the examination and who has faced the trial has been acquitted by the Judgment dated 29.09.2023 passed in Juvenile Case No.2082 of 2022 and the person in whose favour, said person has sat in the examination, has also been granted anticipatory bail in ABA No.772 of 2023.
6. In the attending facts and circumstances of this case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st class, Dhanbad, in connection with Sindri Police Station Case No. 72/2022, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
8. This Anticipatory Bail Application is accordingly allowed and
disposed of.
