Seeking the Court to issue a writ of certiorari and to quash the order that is rendered by the Court of I Additional Principal Judge, Family Court, Bengaluru, on I.A.III in M.C.No.7221/2023 dated 02.04.2025, this writ petition is filed. 3. In the proceedings pending between the parties, respondent herein filed an interlocutory application i.e. I.A.No.III seeking the Court to direct petitioner/husband to pay a sum of ₹65,000/- per month towards her maintenance and maintenance of her minor daughter and ₹20,000/- towards one time litigation expenses. Family Court through the impugned order directed the petitioner to pay the respondent a sum of ₹20,000/- per month towards her maintenance and - 4 - HC-KAR NC: 2026:KHC:8778 WP No. 24575 of 2025 ₹20,000/- per month for the maintenance of the child. Aggrieved by the same this writ petition is filed. 4. Learned counsel for the petitioner submits that respondent is guilty of suppressing her economic status. Learned counsel states that respondent is a Software Engineer and she gets huge amount as salary. Learned counsel brought to the notice of this Court the affidavit given by the respondent giving details of her assets and liabilities. Learned counsel also brought to the notice of this Court the affidavit given by the respondent seeking interim maintenance. As rightly pointed out by learned counsel for the petitioner, respondent has stated different figures pertaining to her salary. In the assets and liabilities she mentioned her monthly income as Rs.55,000/.-. However, in the affidavit given by her in the application filed for grant of interim maintenance, at para 08 she made a mention that she is drawing ₹75,000/- in average as salary per month. Learned counsel also states that - 5 - HC-KAR NC: 2026:KHC:8778 WP No. 24575 of 2025 proceedings for perjury were initiated by the petitioner and the same is pending. 5. Admittedly the child is with respondent/mother. The Court granted a sum of ₹20,000/- per month for maintenance of the child which requires no interference. 6. So far as grant of maintenance to respondent/ mother is concerned, as it is clearly brought on record that she has not furnished her exact salary particulars before the Family Court and as respondent is under obligation to look after the welfare of the child also, this Court is of the view that petitioner is required to be directed to pay respondent a sum of ₹10,000/- per month towards her maintenance. Therefore, writ petition is disposed of with the following ORDER i). The order that is rendered by the Court of I Additional Principal Judge, Family Court, Bengaluru on I.A.No.III in M.C.No.7221/2023 dated 02.04.2025 is - 6 - HC-KAR NC: 2026:KHC:8778 WP No. 24575 of 2025 modified only to the extent of the amount payable as maintenance by the petitioner to the respondent. ii) The sum granted towards interim maintenance is reduced from ₹20,000 to ₹10,000/- per month. iii) Findings given in respect of payment of maintenance to the child are confirmed.
