WPSS No. 57 of 2026 Hon’ble Alok Mahra, J.
Mr. I.D. Paliwal, learned counsel for the petitioner.
2. Mr. Pradeep Hairiya, learned Standing Counsel for the State of Uttarakhand.
3. Petitioner claims to have been appointed on contract as Junior Engineer in Minor Irrigation Department in the year 2010. In this writ petition, he has sought a direction to the authorities to regularise his services as Junior Engineer.
4. It is contended that since petitioner has served continuously for more than 15 years as Junior Engineer against a sanctioned vacant post, therefore, he is entitled to be considered for regularisation under the applicable Rules.
5. Learned State Counsel submits that if petitioner is entitled for regularisation as per the applicable Rules, then his claim shall be considered, as per law. He submits that petitioner may approach the competent authority by making a representation.
6. The writ petition is, accordingly, disposed of with liberty to the petitioner to make representation to the Chief Engineer, Minor Irrigation, within two weeks from today. If petitioner makes representation to the Chief Engineer, decision thereupon shall be taken, as per law, within four months thereafter. If petitioner is found eligible for regularisation, then Chief Engineer shall constitute a Regularisation Committee, which shall thereafter assess the petitioner on various
parameters, as laid down by the applicable Rules.
