Petitioner made application under Section 154 of Zamindari Abolition & Land Reforms Act, but the same has been rejected by the District Magistrate, Nainital, vide order dated 3.1.2025. In this writ petition, petitioner has challenged the said order of rejection, passed by the District Magistrate. (3) It is contended that petitioner’s application was rejected without providing any opportunity of hearing to petitioner. (4) Learned State Counsel, however, submits that the order, whereby application under Section 154 of Zamindari Abolition & Land Reforms Act is rejected, is appealable before Commissioner of concerned Division. For making this submission, he relies upon the Amendment made in Zamindari Abolition & Land Reforms Act, vide Uttarakhand Act No. 11 of 2025. Since petitioner filed this writ petition in 2025, therefore, appeal, if filed by petitioner within two weeks from today, shall be heard and decided on merits, ignoring the question of delay.
