ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), seeking to enlarge the petitioner/Accused No.1 on bail in Crime No.59 of 2022 of Simhadripuram Police Station, Kadapa District, registered against the petitioner/Accused No.1 herein for the offences punishable under Sections 147, 302, 109 read with 149 of the Indian Penal Code, 1860 (for brevity, ‘the IPC’). 2. Notice on respondent No.2 has been served. 3. Sri K.Prudhvi Raj, learned counsel, was appointed as Legal Aid Counsel for respondent No.2. 4. Mr.V.Maheshwar Reddy, learned counsel for the petitioner, submits that the petitioner has not committed any offence; he is falsely implicated in this case; he is the sole breadwinner of his family; he is ready to abide by any conditions that may be imposed by this Court; and urged this Court to enlarge the petitioner/Accused No.1 on bail. 5. Per contra, Mr. A. Sai Rohith, learned Assistant Public Prosecutor, submits that the investigation is not yet completed; if the petitioner is granted bail, there is a likelihood of his repeating the same offence; and urged this Court to dismiss the bail petition. 3 Dr. YLR, J Crl.P.No.7405 of 2026 Dated 08.09.2026
6. Heard the learned counsel for the petitioner, the learned Legal Aid Counsel for respondent No.2 and the learned Assistant Public Prosecutor. Perused the record. 7. As seen from the record, the petitioner was arrested on 27.07.2026 and has been in judicial custody for the past 43 days.
Respondent No.2 is also in judicial custody. Notice on respondent No.2 was served by the Sub-Inspector of Police, Simhadripuram Police Station, who filed a memo to that effect. The name of the petitioner was proposed for deletion from the array of accused during the course of investigation by the police. The petitioner is a permanent resident of Y.S.R. Kadapa District and has got fixed abode. 8. Considering the facts and circumstances of the case and the nature and gravity of the allegations levelled against the petitioner/Accused No.1, this Court is inclined to enlarge the petitioner/Accused No.1 on bail, subject to the stringent conditions. 9. In the result, the Criminal Petition is allowed with the following conditions: i. The petitioner/Accused No.1 shall be enlarged on bail subject to his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the like

sum each to the satisfaction of the learned Judicial Magistrate of First Class, Pulivendula. ii. The petitioner/Accused No.1 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. iii. The petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the learned Trial Judge. iv. The petitioner/Accused No.1 shall not commit or indulge in similar offences while on bail. v. The petitioner/Accused No.1 shall cooperate with the investigating officer in further investigation of the case and shall be available to the investigating officer as and when called by him. _________________________ DR.
