(2) A notice was issued to petitioner by Executive Officer, Nagar Palika Parishad, Kaladhungi on 13.7.2026, asking her to remove the unauthorised occupation made by her over government land. In this writ petition, petitioner has sought the following reliefs: “i. Issue a writ, order or direction, more particularly in the nature of certiorari, thereby quashing the impugned Final Notice bearing पत्रांक नं0-107/स्था०िन०-नोिटस/2026-27 dated 13.07.2026 (Annexure No.7, page No.25 to 25) issued by Respondent No. 2/3, as also the consequential Notices dated 24.06.2025 (Annexure No.3, page No.18 to 19) and 18.11.2025 (Annexure No.6, page No 24 to 24), insofar as the same are addressed to and seek to proceed against Late Nawab Jaan and/or the Petitioner without due process of law; ii. Issue a writ, order or direction, more particularly in the nature of mandamus, directing Respondent No. 2/3 to implead the Petitioner as the legal heir of Late Nawab Jaan, to afford her a full and effective opportunity of hearing, and to decide the reply/representation dated 27.06.2025 (Annexure No.7, page No.25 to 25), including the claim for regularisation, afresh, by way of a reasoned/speaking order, strictly in accordance with law; UKHC010131432026 2026:UHC:6770 iii. Pending admission, hearing and final disposal of the writ petition, stay the operation and effect of the impugned Final Notice dated 13.07.2026 (Annexure No.7, page No. 25 to25), and restrain Respondent Nos. 2 and 3, their officers, agents and subordinates, from taking any coercive action, including demolition/removal of the structure or recovery of any cost/expense as land revenue, pursuant thereto;” (3) This Court does not find any reason to interfere with the impugned notice. However, writ petition is disposed of with liberty to petitioner to submit reply to notice along with all documents in support of her title, before the Executive Officer concerned. If she submits reply within ten days from today, decision thereupon shall be taken, as per law, within one week thereafter.
