JUSTICE R.K. PATTANAIK Order No. ORDER 17.02.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Balanga P.S. Case No.269 of 2025 corresponding to Special G.R. Case No.1073 of 2025 pending in the court of learned J.M.F.C., Nimapara on the grounds stated. 3. Perused the FIR as at Annexure-1. The Court finds that the parties are in a civil dispute and as a result, the alleged incident took place and reported by the informant as per Annexure-1. The submission of learned counsel for the petitioner is that the victims have not received any grievous injury referring to the copies of the medical examination reports as at Annexure-2. Recorded the objection of the State. The reason behind the alleged incident is narrated in the FIR i.e. Annexure-1. Even, though, there has been a claim that bleeding injuries to have been caused to the victims but considering the medical examination report as at Annexure-2, the Court finds that none of the injuries to be grievous. In fact, one of the injured received lacerations but all are stated to be simple with opinion that it might have been caused by blunt object. The petitioner is having no other criminal antecedent as claimed by learned counsel appearing for him. Considering the above facts, circumstances under which the alleged incident took place, this Court, though, not inclined to grant pre-arrest bail to the petitioner but is of the view that he should surrender before the learned court below for being released with stringent conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned J.M.F.C., Nimapara within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with Special G.R. Case No.1073 of 2025 on furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not involve himself in any further mischief against the informant and victims of the assault and to cooperate the I.O. in the investigation, till its completion. 6.
