According to the petitioner, the property originally owned by the petitioner’s father Duraisamy. According to him, after his death, the property should devolve upon all his legal heirs. However, in the patta issued for the subject property, the name of the 4th respondent, who is the mother of the petitioner, alone is mentioned. The petitioner seeks inclusion of the names of all the legal heirs of the deceased Duraisamy. The petitioner had given a representation on 03.11.2025 to the 3rd respondent for the aforesaid purpose. The 2nd respondent has already forwarded the petitioner’s representation to the 3rd respondent on 14.11.2025. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3. Since no adverse order is passed against the 4th respondent, notice to the 4th respondent is dispensed with. 4. No prejudice would be caused to the respondents, if the petitioner’s representation as stated supra is considered on merits and in accordance with law, afte hearing the objections of the 4th respondent and any other party, whom the 2nd respondent deems it fit to enquire, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner’s representation. 5. For the foregoing reasons, this Court directs the 2nd respondent to pass final orders, on merits and in accordance with law, on the petitioner’s representation, dated 03.11.2025 seeking cancellation of the patta standing in the name of the 4th respondent and re-issuance of patta in the names of all the legal heirs of the deceased Duraisamy, after giving due consideration to the supporting documents filed by the petitioner and Page No.3 of 6 https://www.mhc.tn.gov.in/judis W.P.No.13212 of 2026 after hearing all the necessary parties, which includes the 4th respondent, the neighbouring land owners as well as any other party, whom the 2nd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 6. 6. With the aforesaid direction, this Writ Petition is disposed of.
