Kausik CRM (NDPS) 630 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baishnabnagar Police Station Case No. 590 of 2024 dated 26.06.2024 under Section 21(C)/29 of the NDPS Act. Learned advocate appearing for the petitioners submits that the subject matter of the case relates to recovery of 400 Gms. of Brown Sugar. Learned advocate draws the attention of the Court to the order passed in Special Leave to Appeal CRL No. 10877 of 2025 wherein the trial was directed to be completed within 2 months. Such order was passed on 05.01.2026. Learned advocate for the State submits that the case is at the stage of Section 313 of the Code of Criminal Procedure. In the month of February and March, 2026 the learned Judicial Officers were otherwise engaged on administrative assignments, as such, I am of the view that some time may be afforded to the prosecution. As such, within 60 days from the next date fixed, learned Trial Court would try to comply with 2 the directions passed on 05.01.2026 by the Hon’ble Supreme Court of India. Considering the advance stage, I am not inclined to release the petitioner on bail. With the aforesaid directions CRM (NDPS) 630 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
