JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned petition is filed seeking a direction against the respondents to consider petitioner's application - 3 - HC-KAR NC: 2026:KHC:13335 WP No. 15327 of 2025 vide Annexure-D1 dated 20.04.2024 for allotment of a industrial plot. 2. Heard learned counsel appearing for the petitioner, learned counsel appearing for respondent Nos.2 and 4 and learned AGA appearing for respondent Nos.1 and 3. 3. The petitioner–enterprise intends to establish a new Research and Development facility for developing innovative pharmaceutical compounds under the name and style M/s. Radhe Labs. Respondent No.2 issued a Notification dated 25.01.2024 inviting applications for allotment of industrial plots. In the said notification, it is indicated that an extent of 61.45 acres has been earmarked for allotment to Scheduled Castes, Scheduled Tribes and other eligible categories. 4. The petitioner asserts that the competent committee, upon scrutiny of the petitioner’s proposal in its meeting held on 27.02.2024, approved the project - 4 - HC-KAR NC: 2026:KHC:13335 WP No. 15327 of 2025 submitted by the petitioner and recommended allotment of a 0.25 acre industrial plot in the ITIR, Devanahalli General Industrial Area. Pursuant thereto, the petitioner submitted an online application dated 20.04.2024 before respondent No.2 seeking allotment of the said extent of land. The petitioner further contends that, in addition to the online application, a separate representation was also submitted to respondent No.1 requesting allotment of 0.25 acres of land along with the supporting documents. 5. The petitioner further submits that, in compliance with the allotment rules, it has deposited 10% of the tentative allotment price towards Earnest Money Deposit (EMD) amounting to Rs.9,18,000/- on 08.05.2024. Despite submission of the application and payment of the requisite EMD, the petitioner contends that the respondents have not taken any decision on the application. Aggrieved by the inaction on the part of the respondents in considering the petitioner’s application - 5 - HC-KAR NC: 2026:KHC:13335 WP No. 15327 of 2025 dated 20.04.2024 (Annexure–D1), the present petition is filed. 6. Learned counsel appearing for respondent Nos.2 and 4, on instructions, submits that the petitioner’s application would be considered strictly in accordance with law and that appropriate orders would be passed, provided reasonable time is granted by this Court. 7. Recording the said submission made on behalf of respondent Nos.2 and 4, this Court proceeds to pass the following order: ORDER (i) The writ petition is allowed in part; (ii) The respondents are directed to consider the petitioner’s application dated 20.04.2024 (Annexure–D1) seeking allotment of an industrial plot. (iii) While considering the said application, the respondents shall strictly adhere to the - 6 - HC-KAR NC: 2026:KHC:13335 WP No. 15327 of 2025 applicable allotment rules and pass appropriate orders, in accordance with law, within an outer limit of eight weeks from the date of receipt of a copy of this order.
