Admittedly, present appeal has been filed challenging interlocutory order dated 31.08.2026, whereby it has been noted by learned writ Court that there is no representation on behalf of unofficial respondents; official respondents were directed to take appropriate steps for protecting the land as described therein and to take steps for demolition of illegal constructions, if any, on subject land and report within a period of three weeks. Matter was then listed for hearing on 21.09.2026. 2. Learned counsel for writ petitioner submits that arguments in the matter were heard on 17.08.2026 and matter was adjourned to 31.08.2026, at request of learned counsel for present appellant. Learned counsel for appellant submits that it is due to certain unavoidable circumstances that he could not remain present before learned writ Court on 31.08.2026, otherwise, the entire position would have been clarified as is so mentioned in application seeking vacation of interim order dated 30.06.2025 passed in Writ Petition. 4. After arguing for some time, learned counsel for appellant prays for liberty to file appropriate application before learned writ Court for recall of order dated 31.08.2026, bringing entire facts and circumstances of the case before writ Court. 5. In the given facts and circumstances and without expression of opinion on merits of the matter, this writ appeal is disposed of with liberty to appellant to file appropriate application for recall of order dated 31.08.2026. In case such an application is filed within a day, let the same be listed before appropriate Bench. No costs. Pending miscellaneous application(s), if any, also stand(s) disposed of accordingly.
