Petitioner has filed this writ petition, seeking following reliefs:- “10.1 Issue an appropriate writ, order or direction, including a writ of certiorari to quash and set aside the impugned order/ letter dated 09.06.2025 (Annexure P-1) passed by the respondents. 10.2 Issue an appropriate writ, order or direction including a writ of mandamus, directing the respondents to accept and give effect to the petitioner’s application for voluntary retirement in accordance with the applicable rules. 10.3 Direct the respondents to release all consequential retiral and pensionary benefits to the PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 petitioner, including arrears, within a time-bound period. 10.4 In the alternative, direct the respondents to reconsider the petitioners’ application for voluntary retirement and representation dated 23.06.2026 in accordance with law, by passing a reasoned and speaking order within a stipulated time. 10.5 Grant any other relief which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner has submitted an application/ representation for voluntary retirement before Respondent No. 2 on 15.07.2024, however, till date no decision has been taken. He further submits that one communication is made to the petitioner by Respondent No. 3/ Zone Commissioner, who is not a competent authority. When representation/ application is submitted before Respondent No. 2, it will be for the Respondent No. 2 to take decision. 3. Learned counsel for Resp. No. 2 & 3 opposes the submission of learned counsel for petitioner and further submits that in the facts of the case and submission made by counsel for petitioner, Respondent No. 2/ Commissioner will pass an order afresh in accordance with law. 4. On due consideration of the submission made by learned counsel for the respective parties, facts and circumstances of the case, this writ petition at this stage is disposed off directing Respondent No. 2 to consider and take decision on the representation/ application submitted by petitioner for voluntary retirement dated 15.07.2024, in accordance with law, expeditiously, preferably within an outer limit of 04 weeks from the date of receipt of copy of order passed by this Court. 5.
