By way of this petition, the petitioner is praying for transfer of the HMA Petition No. 1020 of 2025, titled Dinesh Kumar Vs. Muskan, which is presently pending before the Court of learned Additional District & Session Judge, Nalagarh, 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:1278 District Solan, H.P., to the Court of learned Principal Judge, Family Court at Hamirpur, H.P. 2. Learned Legal Aid Counsel has apprised the Court that a divorce petition has been filed against the petitioner by the respondent, which presently is pending adjudication at Nalagarh. She submitted that the petitioner is residing at her parental home at Village Chalagarh, P.O. Dangri, Tehsil Nadaun, District Hamirpur, H.P. She apprised the Court that the petitioner is unemployed and has no source of income and is dependent upon her parents for her day to day expenses. She submitted that in these circumstances as it is not practically possible for the petitioner to defend herself at Nalagarh, which Court is at a distance of approximately 100 Km from her parental house, the case be ordered to be transferred to Hamirpur. 3. Having heard learned Legal Aid Counsel and having perused the averments made in the petition and more so, in light of the fact that the respondent has chosen not to oppose the petition despite service, this petition is allowed, as prayed for. The case in issue i.e. HMA Petition No. 1020 of 2025, titled 3 2026:HHC:1278 Dinesh Kumar Vs. Muskan, is hereby ordered to be transferred from the Court of learned Additional District & Session Judge, Nalagarh, District Solan, H.P., to the Court of learned Principal Judge, Family Court at Hamirpur. The Court places on record its appreciation for the assistance rendered by the learned Legal Aid Counsel and it is ordered that the full fee payable to a Legal Aid Counsel for conducting a case be paid to the learned Legal Aid Counsel.
