Musurumilli Project, Rampachodavaram,East Godavari District. ...Respondent Counsel for the Petitioner: B SAI PRIYA Counsel for the Respondent MADHAVI PRIYA MANTENA The Court made the following: 2 THE HONOURABLE SRI JUSTICE D.RAMESH AND THE HONOURABLE SRI JUSTICE A.HARI HARANADHA SARMA CIVIL MISCELLANEOUS APPEAL No.205 OF 2012 JUDGMENT: (Per Hon’ble Sri Justice D.Ramesh) The unsuccessful petitioner filed the present appeal against the order dated 01.11.2011 in O.P.No.216 of 2010 on the file of the Court of the III Additional Senior Civil Judge, Kakinada. 2. The said O.P.No.216 of 2010 was filed by the appellant/petitioner/wife under Section 13(1)(ia)(ib) of the Hindu Marriage Act, 1955 seeking divorce on the grounds of desertion and cruelty. After considering the matter on merits, the Court below dismissed the said O.P. 3. While pending the appeal, the matter has been referred to the Mediation Centre vide order dated 28.01.2026. Subsequently, the Mediation Centre has submitted a Mediator Report dated 03.07.2026. As per the said report, both the parties have filed an affidavit dated 31.08.2026. Along with the said affidavit, both the parties have agreed to take divorce by mutual consent. 3 4. Consequent to the aforesaid affidavit, today, both the parties are present before this Court and they are identified by their respective counsel and also on the basis of the identity cards submitted by them. Both the parties submitted that all the claims inter se have been settled and no further claims against any party and they have independently expressed their willingness to record the consent. 5. Considering the request made by both the parties, O.P.No.216 of 2010 on the file of the Court of the III Additional Senior Civil Judge, Kakinada, is converted into a petition under Section 13B of the Hindu Marriage Act. 6. Accordingly, the Civil Miscellaneous Appeal is allowed, setting aside the order dated 01.11.2011 in O.P.No.216 of 2010 on the file of the Court of the III Additional Senior Civil Judge, Kakinada and granting divorce by mutual consent, thereby dissolving the marriage between the parties from today.
