THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER This petition is filed assailing the order dated 19- 21/05/2012 marked at Annexure-E.
2. In terms of the said order, the date of probation of the petitioner is changed. Learned counsel for the petitioner submits that earlier the petitioner and few other employees had filed Writ Petitions No.53257-283/2003 to consider their representation for change of date of probation. The Court allowed the petitions and directed the respondent-Corporation to consider the petitioner's representation. The petitioner submits that the representation was considered and the petitioner's claim was accepted and date of probation was changed in terms of order dated 13.09.2006.
3. It is his further submission that in terms of the impugned order, the date of probation is again changed and it has been restored to the original position and that is done

without hearing the petitioner.
4. The respondent-Corporation though has filed statement of objection has not produced the show cause notice issued to the petitioner before passing the order impugned. The Court is of the view that the order could not have been recalled without hearing the petitioner as it has got implication on the service conditions of the petitioner.
5. Under these circumstances, the impugned order is set aside. The matter is remitted to the Corporation for fresh
consideration in accordance with law.
6. The Respondent-Corporation shall issue notice in case it intends to alter the date of probation of the petitioner and petitioner shall respond to the said show cause notice and thereafter, the appropriate order shall be passed.
7. The exercise shall be completed within one month. In case, not done, the amount recovered from the petitioner pursuant to the impugned order will have to be repaid to the petitioner with 6% interest from the date of recovery till the

date of payment.
