1. Heard learned counsel for the parties.
2. The present writ petition has been filed for the following reliefs :-
“(a) for issuance of a writ in the nature of mandamus or an appropriate writ/ Rule/ order/ direction for commanding the Respondents to make payment of compensation of land as per Notification/letter No. F. No. 43020/25/2015-LA&IR, dated 04/08/2017 issued by Government of India, - 1 - W.P.(C) No.7802 of 2025
2026:JHHC:1758 Ministry of Coal, measuring an Area 1.20 acres in respect to Plot No.437 under the khata No.37 of Mouza/ Village-Gutwai, Thana 105, District -Bokaro, which has been acquired by the respondents BCCL authorities for Coal Mining through the process of law. (b) Commanding the Respondents for payment of interest on the amount of compensation, since the Respondents have delayed the payment on one or other plea, and also for payment of Solatium on the entire amount of compensation at the present market rate as per "The Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act 2013.”
3. The law operating in the field is Section 14(2) of the Coal Bearing Areas (Acquisition & Development) Act, 1957, which reads as under :-
“14. Method of determining compensation.—(1) ------ (2) Where no such agreement can be reached, the Central Government shall constitute a Tribunal consisting of a person who is or has been or is qualified to be a Judge of a High Court for the purpose of determining the amount. (3) -------.”
4. Thus, the legal regime itself provides Forum for resolving the dispute.
5. In that view of the matter, I am not inclined to entertain the present writ petition, accordingly, it is, hereby, disposed of giving liberty to the petitioner to invoke the appropriate Forum in accordance with law.
6. Pending interlocutory application, if any, stands
disposed of.
