303. sg 10-04-2026 Ct. 19 WPA 11999 of 2025 Akshay Kumar Ghosh Versus State of West Bengal & Ors. Mr. Haradhan Mondal
...for the petitioner Mr. Chandi Charan De, AGP Mr. Anirban Sarkar …for the State
Affidavit of service filed in Court is taken on record. The learned Advocate appearing for the petitioner submits that in spite of letter demanding justice dated 21st July, 2023 requesting the District Land & Land Reforms Officer, Birbhum to correct the recording of the share of the petitioner respect of the plot in question, no steps have been taken by such authority. Thus, the petitioner alleges inaction and/or culpable negligence on the part of an authority under the West Bengal Land Reforms Act, 1955, which is specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. Since an alternative and efficacious remedy is available under the 1997 Act, this Court is not inclined to entertain this writ petition. Accordingly, this writ petition stands disposed of by leaving the petitioner free to approach the appropriate form in accordance with law.
