Learned advocate for the petitioner submits that the petitioner is in custody since 19th February, 2026; the investigation has already been completed and some of the accused persons have been released on bail, as such, he prays that the petitioner may be enlarged on bail. Learned advocate for the State opposes the prayer for bail and produces the case diary. I have taken into account the statement of the injured which generally implicates all the accused persons. Having considered that some of the accused persons have been enlarged on bail and the petitioner is in custody for more than 58 days, I am inclined to enlarge the petitioner on bail.
2 Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Sk. Hasmat Ali shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned CJM, Tamluk, Purba Medinipur. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned court and shall not leave the district of Purba Medinipur without prior intimation to the learned court. Additionally, the petitioner shall also meet with the Inspector-in-charge of the Kolaghat Police Station once in a fortnight till the stage of consideration of charge is over. Accordingly, CRM (M) 708 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
