C.R.P. (MD) No. 1294 of 2024 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 21.01.2026 CORAM THE HON'BLE MR. JUSTICE N.SENTHILKUMAR C.R.P. (MD) No. 1294 of 2024 and C.M.P. (MD) No. 7447 of 2024 A.Chithirai Selvan @ Surya ... Petitioner -vs- Dhanalakshmi ... Respondent Prayer:- Petition filed under Article 227 of the Constitution of India, to call for the records and set aside the fair and decreetal order dated 22.12.2023 passed in I.A. No. 3 of 2022 in H.M.O.P. No. 78 of 2021 on the file of the Sub-Court, Devakottai by allowing this Civil Revision Petition. For Petitioners : Mr. T.Balakrishnan O R D E R This Civil Revision Petition challenges the order dated 22.12.2023 passed in I.A. No. 3 of 2022 in H.M.O.P. No. 78 of 2021 on the file of the Sub- Court, Devakottai (hereinafter referred to as “Trial Court” in short) granting 1/4 https://www.mhc.tn.gov.in/judis C.R.P. (MD) No. 1294 of 2024 interim maintenance for a sum of Rs.10,000/- each to the children of the husband and Wife, who are the parties herein. 2. Heard Mr. T.Balakrishnan, Learned Counsel for the Petitioner and perused the materials placed on record apart from the pleadings of the parties. 3. It is the common case of the parties that the children are presently in the custody of the Wife and both the Husband and Wife are working as Teachers. The Husband owes duty to take care of the maintenance of the children and hence, granting interim maintenance for a sum of Rs.10,000/- each to the children appears to be reasonable and this Court does not find any reason to interefere with the impugned order in the exercise of its superintending jurisdiction under Article 227 of the Constitution of India. 4. The Hon'ble Supreme Court of India in the decision in Manisha Mahendra Gala -vs- Shalini Bhagwan Avatramani (Order dated 10.04.2024 in Civil Appeal No. 9642 of 2010) has laid down the parameters under which the Court interferes under Article 227 of Constitution of India. The facts of this case would not show any reason for this Court to interfere at the stage of the proceedings. For all the aforesaid reasons, this Court is not unable to entertain 2/4 https://www.mhc.tn.gov.in/judis C.R.P. (MD) No. 1294 of 2024 the Civil Revision Petition.
