IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.1188 of 2026
Anjana Naik
… Petitioner Mr. M. Das, Advocate
-versus- State of Odisha … Opposite Party Mr. T.K. Acharya, Addl. PP JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) 18.03.2026
01.
1. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Darakote PS Case No.232 of 2025 corresponding to ST Case No.507 of 2025 pending in the Court of learned Addl. Sessions Judge, Aska, Ganjam for commission of offence punishable U/S. 103(1) of BNS, on the main allegation of committing murder of her own husband.
2. Heard, Mr. Mahes Das, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record including the copy of deposition of PW1 to PW4.
3. Admittedly, the Petitioner is the wife of the deceased, but the witnesses who have been described as eye witnesses in the charge sheet having been examined as PW1 to PW4, have not supported the prosecution allegation against the Petitioner. Besides, the Petitioner is a lady and she is in custody since 18.06.2025. Since the material witnesses have already been examined, there is hardly any apprehension of tampering of evidence of material witnesses like PW1 to PW4. In the aforesaid facts and situation and taking into account the pre trial detention of
the Petitioner in custody and her status as a lady and applying the first proviso appended to Sec. 480 of BNSS, this Court without expressing any view on merits admits the Petitioner to bail.
4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
