The mother of the petitioner has already superannuated after attaining the age of superannuation. 3. This is a case where the petitioner claimed that the mother had applied for voluntary retirement but the matter was kept pending and ultimately the mother of the petitioner was allowed to superannuate in natural course, thus the benefit of female voluntary retirement scheme which was prevalent at that point of time before being declared as ultra vires could have been applied to the petitioner and he would have got the relief. 4. Considering the nature of the prayer made by the petitioner and the fact that the female VRS scheme has already been declared ultra vires and further the mother of the petitioner has superannuated in natural course, no relief can be granted to this petitioner. 5.
