1. Learned advocate for the petitioner submits that similarly placed accused person has been granted bail in CRM (M) 196 of 2026.
2. Learned advocate for the State opposes the prayer for bail.
3. I have taken into account the materials on record. On query from this Court, learned Advocate for the State is unable to refute the condition of parity so far as the present petitioner is concerned with the other accused who has been granted bail. As such, I am inclined to release the petitioner on bail.
4. Accordingly, the petitioner namely Upendra Ram be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned CJM, Howrah. If on bail, the petitioner shall be physically present on each and every date of
2 hearing before the jurisdictional court and shall not leave the district of Howrah without prior permission of the trial court.
5. In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court.
6. With the aforesaid observation, CRM (M) 652 of 2026 is allowed.
