The petitioner is apprehending his arrest in connection with Nagri P.S. Case No.172 of 2025, for offence registered under section 126(2), 115(2), 118(1), 74, 308(3), 352, 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, Ranchi. 3. Learned counsel for the petitioner submits that the petitioner happened to be auto driver and the informant along with her husband was travelling on another auto which was of her husband and the allegations are made that the petitioner intercepted and demanded money. He also submits that the altercation took place for taking of the passenger in either of the auto. He next submits that the petitioner has also received injury and for that, the wife of this petitioner has lodged Nagri P.S. Case No.170 of 2025 and thereafter the present case has been lodged against the petitioner being Nagri P.S. Case No.172 of 2025. He next 2026:JHHC:2714 -2- submits that there is no injury upon the body of the husband of the informant and the informant and the husband of the informant has been taken into custody in the case lodged by the petitioner’s side. 4. Learned State counsel as well as the learned counsel for the informant oppose the prayer and submit that allegations are made of even outraging the modesty of the informant. 5. Considering that the petitioner has received injury pursuant to the said altercation and for that the wife of this petitioner has lodged Nagri P.S. Case No.170 of 2025 and thereafter the present case has been lodged against the petitioner and the petitioner happened to be auto driver and further there is no injury on the body of the husband of the informant and the informant, however, the allegations are made of assault by knife, and in that view of the matter, the petitioner, above named, is directed to surrender before learned court within two weeks from today and learned court shall release petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
